During the State of Emergency:  For APRNs who's patients require Schedule II medications see the changes below. 

(UPDATED 4/15/2020) West Virginia APRNs with current prescriptive authority and an active DEA number, who are approved to practice in West Virginia during the State of Emergency, may refill Schedule II drugs of the Uniform Controlled Substances Act, and antineoplastics, if the patient has been on these medications. Schedule II prescriptions are permitted to be refilled if the refill is required during the declared emergency.
Please contact the DEA office at one of the following numbers: 304-347-5210 or 571-362-5667.  The investigator who answers the call will have verification questions for the registrant.  Once everything has been verified, Schedule II authority will be added to the registration.  NOTE: Each APRN must make this call individually.  The DEA will not add the Schedule II authorization unless YOU make the call.  
The prescribing physician’s name must be written on the prescription as well as the last date the prescription was filled. The Board of Pharmacy requests the name of practitioner and prescription number of the original prescription the APRN is refilling.  They suggest notifying that practitioner as well.

In an effort to facilitate continuous patient care during quickly changing scenarios that are arising from the COVID-19 pandemic, DEA has issued several exceptions to its regulations.  One of these exceptions pertains to the “five percent” rule.

The guidance letter, titled DEA Practitioners 5% Rule Exception, provides an exception to the “five percent” rule, allowing for the distribution of controlled substances of more than five percent that a practitioner can distribute to another practitioner during the calendar year.

This exception is in effect from January 1, 2020, until the date this exception ends.
